Terms and Conditions

1. Introduction

These Terms and Conditions of Purchase (“Terms”) govern the purchase of products and services from Concord Lamp & Shade. (“we,” “us,” “our”). By placing an order, you (“Customer,” “you,” “your”) agree to these Terms.

2. Orders

2.1. Order Placement: Orders can be placed through our website, phone, or email. All orders are subject to acceptance by us.

2.2. Order Confirmation: Upon receiving your order, we will send an order confirmation. This confirmation does not constitute acceptance of your order; it is simply an acknowledgment that we received it.

2.3. Order Acceptance: Acceptance of your order and the formation of a contract between us will occur only when we dispatch the products to you.

3. Pricing and Payment

3.1. Pricing: All prices are listed in US Dollars. Prices are subject to change without notice but will not affect orders already accepted.

3.2. Payment: Payment can be made via Visa, Mastercard, Discover or American Express. Payment is due at the time of order placement unless otherwise agreed.

4. Shipping and Delivery

4.1. Shipping: We offer ground shipping on the website. Shipping costs are calculated at checkout and are the responsibility of the customer.

4.2. Risk of Loss: Risk of loss passes to you upon delivery of the products to the carrier.

6. Returns & Warranties 

6.1. Returns: If for any reason you are not satisfied with your purchase, you may return any fixtures that have not been installed, any lamps that have not been used and any lampshades that have not been opened, for refund or exchange within 30 days of receipt by following these important steps. Please understand that any installed fixtures, or custom designed fixtures or lamps, or lampshades that have been unwrapped, are non-returnable.

6.2. Product Warranties: Warranty coverage is the responsibility of fixture or lampshade manufacturer. 

6.3. Exclusions: Items ineligible for returns include: Custom orders (products that are built to order);

Special purchases including: clearance items, inventory sale items, discontinued items or special discounts; Any item that has been assembled, installed, modified or used in any way; Any lampshade that has had its original covering removed; Any item that is not in re-saleable condition; Any item that is not accompanied by a return authorization number; Large orders (those containing 6 or more of a single item). When ordering large quantities, we suggest ordering a sample for evaluation; Items shipped by Truck Freight or by Expedited Shipping; Product received by the customer over 30 days ago.

7. Limitation of Liability

7.1. Maximum Liability: Our maximum liability for any claim arising out of or in connection with these Terms will not exceed the amount paid by you for the products.

7.2. Exclusion of Damages: We will not be liable for any indirect, incidental, or consequential damages.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of Massachusetts. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Massachusetts.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued purchase of products or services will constitute your acceptance of the revised Terms.
